Section 01
General Terms

GRADIT App for College is a Communication product that has been developed by Savyasasy. The format, design and all aspects of this solution is the sole intellectual property of Savyasasy.
ii
GRADIT App for College provides only a platform for Users to transmit messages to the target audience. Savyasasy will not be responsible in any way for the content transmitted through this platform.

The Users of GRADIT by using the Mobile App for College indemnify Savyasasy from liability or cause of action arising from any content transmitted through this platform.

The use of GRADIT App for College by Users/Subscribers is subject to the appropriate laws as applicable and as determined by the laws of the land. The service is offered subject to the operating conditions prescribed by the laws of the land. Hence the service is subject to change, and within the overall compliance of policies and conditions prescribed by them.

GRADIT App for College functionality is entirely dependent on the Telecom Networks and Telecom Service Providers from whom the telephone lines have been procured. Hence Savyasasy shall not be held responsible for the non-performance/partial/faulty performance of the functionalities or all functionalities of the product, at times.

Savyasasy reserves the right, at its sole discretion, to accept or reject Users/Subscribers at any point in time. It is not liable to provide any explanation or reason to any User/Subscriber in the event of terminating any User/Subscriber account. Savyasasy will refund any money deposited with Savyasasy after deducting for any usage or other.

User/Subscriber shall not use GRADIT App for College in any manner that is in contravention with the Laws of India.
Section 02
Data and Security
i
Savyasasy is not aware of the nature and content of the message transmitted to the User and such contents are not monitored by Savyasasy. Any illegal use of the facility, when brought to the notice of Savyasasy shall entail immediate disconnection of the service.
ii
Savyasasy will not disclose the personal data of User to any third party for any other commercial activity or marketing activity without the prior consent of the User.
iii
User agrees that Savyasasy can send messages regarding new product features, special offers and other promotional information/material to them.
iv
User can at any time, opt out from receiving such promotional messages from Savyasasy. However this shall not include technical messages related to usage, payment balance, upgrade and bug fix related messages.

Savyasasy operates and offers GRADIT App for College under the relevant laws of the land. If Competent Authorities, duly authorized by law, seek information on usage of the system, the same shall be provided by Savyasasy with or without informing the User.

All contents of the communication will be kept on GRADIT servers for a period of 15 days. After this period, the files will be deleted from GRADIT servers. During this period, User can download the files for their reference.

The above time period is subject to change at the sole discretion of Savyasasy without any notice to the User.

The facility to record the messages, send text messages, circulars and images are provided based on the current rules and regulations that govern telecom providers and service providers. In the event, there is a regulatory restriction or orders to stop such facility, the same shall be withdrawn by Savyasasy with/without prior notice.

Notwithstanding the above, Savyasasy reserves the right to withdraw this facility with/without any reason or notice.

User will not hold Savyasasy liable for any partial or full failure of the recording feature.
Section 03
Technical and Information Access to the User Phone Features
i
GRADIT App for College will access information/data of individual User that relate to the provision of service of GRADIT App for College services and proper functioning of the App. By using the Messenger, the User by default agrees that such information/data can be accessed and used by GRADIT App for College App for the smooth functioning of the application.
ii
GRADIT App for College will access certain phone features of the User such as Internet and Network Access, Identity and Status and dialer settings for the functioning of this App. GRADIT App for College App will also access and modify data in the User's device. User agrees to allow the GRADIT App for College App to do the same.
Section 04
Indemnification
i
The User indemnifies GRADIT from any potential losses or damages as a consequence of partial or total non-performance of GRADIT App for College solution.
ii
The User indemnifies GRADIT from any potential loss caused to User by leakage of their data that is a result of hacking or cyber crime on GRADIT infrastructure.
iii
The User indemnifies GRADIT against any unlawful use by them of the GRADIT App for College Services.
iv
The User indemnifies GRADIT for any discrepancy, fault, or non-fulfillment of any transaction with Mobile Wallet Provider systems that is routed through GRADIT App for College App.
v
The User/Subscriber indemnifies GRADIT for any leakage or abuse of their data by the Mobile Wallet Provider and any or all such claim for damages with regard to the same will be exclusively with the Mobile Wallet Service Provider.
Section 05
Termination
i
The User indemnifies GRADIT from any potential losses or damages as a consequence of partial or total non-performance of GRADIT App for College solution.
ii
Savyasasy reserves the right to terminate the provision of GRADIT App for College services without notice to any User.
Section 06
Intellectual Property
i
All Intellectual Property and Copyright related to GRADIT App for College are the exclusive property of Savyasasy.
ii
User/Subscriber shall not in any manner, copy the format, design, and technical aspects of GRADIT App for College or provide any support to any third party to do the above.
iii
The logo and design of the GRADIT App for College App and Savyasasy are the exclusive trademarks of Savyasasy and the same shall not be used or copied by any User/Subscriber.
Section 07
Jurisdiction
i
The User by usage of the Messenger confirms that the usage of the Messenger and the above terms and conditions shall be subject to the exclusive jurisdiction of the courts of Chennai only.
